Social Security DisabilitySouth Carolina Social Security Disability LawyersThe Social Security system provides two benefit programs for disabled persons: Social Security Disability (Title II) and SSI (Supplemental Security Income). Social Security Disability (Title II) is for workers covered by Social Security who have contributed to a Social Security account while working for a specified period of time, usually 5 out of the last 10 years of work. Disabled widows and widowers of Social Security wage earners may also qualify. Social Security disability beneficiaries receive two primary benefits: a monthly check and medical benefits. The amount of the monthly check is determined by a formula that takes into account the amount paid into Social Security and the length of time of employment. SSI (Supplemental Security Income) provides disability benefits for low income persons not covered by Social Security. It can also be added to Social Security benefits which are lower than a certain minimum level. SSI (Supplemental Security Income) does not require previous employment and monthly benefits are based upon "need", considering the individual's other income and assets. Special rules apply for legal residents who are not citizens. As a service to our personal injury and workers' compensation clients, Strom Law Firm helps clients in Columbia and in the surrounding areas of South Carolina to navigate the administrative system and obtain disability benefits. Our attorneys have successfully represented many people who were initially denied benefits. We do this by exercising their right to file for a reconsideration hearing, by arguing the case in front of an administrative law judge, and by exercising their right to appeal whenever appropriate. For specific information, please see:
The interplay between SSI and workers' compensation benefits is also an area that we can turn to our client's advantage. Many times, worker's comp benefits will be offset based on the circumstances of their disability and the amount of Social Security disability benefits they have received. Our lawyers can help reduce the offset and spread it out over the lifetime of the disabled individual, resulting in higher benefit payments each month so long as the workers' comp claim is pending when we are retained. Lastly, we understand how the combination of a benefits denial, medical bills, lost wages and lost assets can create a difficult financial situation for an individual and their family. The firm has the experience and legal resources to appeal these cases and advocate for the benefits that will help you get on the road to recovery and on with your life. Toll Free 888.490.2847
